1. Agreement to Terms

By accessing or using the Stepform platform at www.stepform.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Stepform is a web-based platform that enables users to create, publish, and manage multi-step forms and funnels. The Service includes a form builder, real-time collaboration tools, form hosting, submission management, analytics, and integrations with third-party services.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 16 years of age to create an account and use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Collect personal data from respondents without a lawful basis under GDPR or other applicable data protection laws
• Send spam, phishing attempts, or other unsolicited communications
• Distribute malware or any harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Create forms that collect sensitive personal data (as defined in Art. 9 GDPR) without appropriate legal safeguards
• Use the Service for any fraudulent or deceptive purpose

We reserve the right to suspend or terminate your account if we reasonably determine that you have violated these Terms.

5. Your Content

5.1 Ownership

You retain all rights to the content you create, upload, or collect through the Service ("Your Content"), including forms, pages, designs, and submission data. Stepform does not claim ownership of Your Content.

5.2 License to Stepform

By using the Service, you grant Stepform a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process Your Content solely for the purpose of providing and improving the Service.

5.3 Responsibility

You are solely responsible for Your Content, including ensuring that it complies with applicable laws (including GDPR) and does not infringe the rights of any third party. When collecting personal data from respondents, you act as the data controller and must provide appropriate privacy notices and legal bases for processing.

6. Data Processing

When you use Stepform to collect data from form respondents, we act as a data processor on your behalf. Our data processing practices are described in our Privacy Policy. For customers who require a formal Data Processing Agreement (DPA) under Article 28 GDPR, please contact us at privacy@stepform.ai.

7. Intellectual Property

The Service, including its original content (excluding Your Content), features, functionality, design, and underlying technology, is and remains the exclusive property of Stepform and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the Service.

8. Third-Party Integrations

The Service may integrate with third-party services (e.g., Google Ads, Meta Pixel, HubSpot, Webhooks). Your use of third-party services is governed by their respective terms and privacy policies. Stepform is not responsible for the practices of third-party services.

When you enable third-party tracking on your published forms, you are responsible for disclosing this to your respondents and obtaining any necessary consent.

9. Subscription and Payments

• Certain features of the Service may require a paid subscription.
• Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on the plan you select.
• All fees are exclusive of applicable taxes unless stated otherwise.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• We reserve the right to change our pricing with 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Stepform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Stepform's total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to Stepform in the 12 months preceding the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your specific requirements or that it will be uninterrupted, timely, secure, or error-free.

13. Indemnification

You agree to indemnify and hold harmless Stepform and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

14. Termination

• You may terminate your account at any time by deleting it through your account settings or contacting us.
• We may suspend or terminate your account at any time for violation of these Terms, with or without notice depending on the severity.
• Upon termination, your right to use the Service ceases immediately. Your data will be deleted within 30 days of account termination, unless retention is required by law.
• Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will survive.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. For consumers within the EU, mandatory consumer protection laws of your country of residence apply to the extent they provide greater protection.

Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to your right as a consumer to bring proceedings in the courts of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
